Welcome to Zyntra. These Terms of Service (“Terms”) are a binding
agreement between you and Zyntragram (“we”, “us”, “our”), the operator
of the Zyntra mobile application and related services (the “Service”).
Please read them carefully.
We provide the Service as an “intermediary” within the meaning of
Section 2(1)(w) of the Information Technology Act, 2000 (“IT Act”) and
the Information Technology (Intermediary Guidelines and Digital Media
Ethics Code) Rules, 2021 (“IT Rules”). These Terms, together with our
Privacy Policy, constitute the “rules and
regulations”, “privacy policy” and “user agreement” required under
Rule 3(1)(a) of the IT Rules.
By accessing or using the Service, you agree to these Terms and the
Privacy Policy. If you do not agree, you may
not use the Service.
1. Eligibility and accounts
You must be at least 18 years old to use the Service, consistent with the Digital Personal Data Protection Act, 2023 (India). Accounts found to belong to users under 18 will be suspended or terminated.
You are responsible for maintaining the security of your account, including your password and recovery code. You are responsible for all activity that occurs under your account.
You agree to provide accurate information and to keep your profile and contact details current.
You may not create an account using someone else’s identity, impersonate any person, or operate multiple accounts for abusive purposes.
2. Account tiers
The Service offers three account tiers, each with different features and
requirements:
Temporary (Guest): Quick-access account without a password. Limited features and limited recoverability. Intended for trying out the Service.
Registered: Password-secured account. Recovery code available. Most core features unlocked.
Verified: Email-verified account. Highest tier; all features available.
We may change the features available in each tier with reasonable
notice.
3. Acceptable use
Our Community Guidelines explain in plain
language what is and isn’t allowed on Zyntra and how violations are
handled. They are incorporated into these Terms by reference.
As required by Rule 3(1)(b) of the IT Rules, you must not host,
display, upload, modify, publish, transmit, store, update, or share
any information that:
Belongs to another person and to which you do not have any right;
Is defamatory, obscene, pornographic, paedophilic, invasive of another’s privacy (including bodily privacy), insulting or harassing on the basis of gender, libellous, racially or ethnically objectionable, relating to or encouraging money laundering or gambling, or otherwise inconsistent with or contrary to the laws of India in force;
Is harmful to a child;
Infringes any patent, trademark, copyright or other proprietary rights;
Deceives or misleads the addressee about the origin of the message, or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature;
Impersonates another person;
Threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, public order, or causes incitement to the commission of any cognizable offence, or prevents investigation of any offence, or is insulting to any other nation;
Contains software virus or any other computer code, file or program designed to interrupt, destroy or limit the functionality of any computer resource;
Is patently false and untrue, and is written or published with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
In addition, you agree not to:
Send spam, chain messages, mass-unsolicited messages, or engage in coordinated inauthentic behaviour.
Scrape, crawl, or use automated means to access the Service in a way that imposes an unreasonable load on our systems.
Reverse-engineer, decompile, or attempt to extract source code, except as permitted by law.
Resell, sublicense, or commercially exploit access to the Service without our written permission.
Bypass or attempt to circumvent any security, rate-limiting, or moderation systems.
4. Your content
“Your Content” means any text, images, audio, video, comments, profile
information, or other material you submit to the Service.
Ownership. You retain ownership of Your Content. We do not claim ownership over what you create.
License you grant us. You grant Zyntragram a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to host, store, reproduce, modify (for technical reasons such as formatting, compression, or moderation), display, and distribute Your Content as necessary to operate, provide, and promote the Service. This license ends when you delete Your Content or your account, except as needed for backups, legal compliance, or to enforce these Terms.
Your responsibility. You are solely responsible for Your Content and the consequences of sharing it. You represent that you have all rights necessary to grant the above license and that Your Content does not violate these Terms or any law.
Feedback. Any suggestions or feedback you provide may be used by us without restriction or compensation.
5. Our content and intellectual property
The Service, including its software, design, trademarks, and logos, is
owned by Zyntragram and its licensors and is protected by intellectual
property laws. Except for the limited license to use the Service granted
to you under these Terms, no other rights are granted.
6. Moderation, suspension, and termination
We use a combination of automated systems, user reports, and human review (collectively, our Trust & Safety processes) to identify violations of these Terms.
We may, at our discretion: remove or hide content; restrict features (such as messaging cooldowns); suspend or terminate accounts; or take other reasonable measures.
We will give notice where reasonably possible, except where notice would compromise safety, an ongoing investigation, or our legal obligations.
You may stop using the Service at any time and deactivate or delete your account from Settings or by contacting us.
Sections that by their nature should survive termination — including ownership, license to your content already posted, disclaimers, liability limits, and dispute resolution — will survive.
7. Notice and takedown
If you believe content on the Service violates these Terms, infringes
your rights, or is unlawful, please report it through the in-app
report flow or contact our Grievance Officer (see
Section 16).
In line with Rule 3(2) of the IT Rules, we will:
Acknowledge receipt of your complaint within 24 hours;
Dispose of the complaint within 15 days from receipt;
Remove or disable access to content that exposes the private area of a person, shows them in full or partial nudity, depicts a sexual act, or constitutes impersonation (including artificially generated or morphed content) within 24 hours of a valid complaint;
Cooperate with lawful directions from a court of competent jurisdiction or appropriate government agency in India.
8. Advertising
The Service may display advertising provided by third-party networks
such as Google AdMob. Advertisers may use device identifiers and
interaction data per their own policies. You can control some
ad-related settings through your device’s OS-level controls (Limit Ad
Tracking / opt-out of personalized ads).
9. Privacy
Our handling of your information is described in our
Privacy Policy, which is incorporated into these
Terms by reference.
10. Intermediary status and safe harbour
Zyntragram is an “intermediary” under Section 2(1)(w) of the IT Act
and avails the safe-harbour protection under Section 79 of the IT Act,
subject to compliance with the IT Rules. We do not initiate the
transmission of user content, do not select the receiver of the
transmission, and do not select or modify the information contained in
the transmission, save as necessary for operating the Service
(formatting, compression, moderation, security).
We observe due diligence under Rule 3 of the IT Rules, publish these
Terms, our Privacy Policy and the rules and regulations to which users
are subject, and act on complaints within the prescribed timelines
(see Section 7).
11. Disclaimers
The Service is provided “as is” and “as available”,
without warranties of any kind, whether express, implied, or statutory,
including any warranties of merchantability, fitness for a particular
purpose, non-infringement, accuracy, or uninterrupted operation, to the
maximum extent permitted by applicable law.
We do not warrant that the Service will meet your requirements, be
uninterrupted, secure, or error-free, or that any defects will be
corrected. You use the Service at your own risk.
12. Limitation of liability
To the maximum extent permitted by law, Zyntragram and its officers,
employees, agents, and affiliates will not be liable for any indirect,
incidental, special, consequential, exemplary, or punitive damages,
including loss of profits, revenue, data, goodwill, or other intangible
losses, arising out of or related to your use of the Service.
Our total liability for any claim arising out of or related to these
Terms or the Service shall not exceed the greater of (a) the amount you
paid us for the Service in the 12 months preceding the event giving
rise to liability, or (b) INR 1,000.
Some jurisdictions do not allow the exclusion or limitation of certain
damages; in those jurisdictions, the above limitations apply only to
the extent permitted by law.
13. Indemnification
You agree to indemnify and hold Zyntragram, its affiliates, officers,
employees, and agents harmless from any claim, demand, loss, liability,
or expense (including reasonable legal fees) arising out of (a) your
use of the Service in violation of these Terms or applicable law, (b)
Your Content, or (c) your violation of any third-party right.
14. Changes to the Service and Terms
We may add, change, or remove features at any time. Where feasible we will give reasonable notice for changes that significantly reduce features you rely on.
We may update these Terms from time to time. If changes are material, we will notify you through the Service or by other reasonable means. By continuing to use the Service after the updated Terms take effect, you accept the changes. If you do not agree, you must stop using the Service.
15. Governing law and disputes
These Terms are governed by the laws of the Republic of India,
including the Indian Contract Act, 1872, the IT Act, the IT Rules, the
DPDPA, and the Consumer Protection Act, 2019, as applicable.
Subject to the rights of consumers to approach the appropriate
consumer forum under the Consumer Protection Act, 2019, the courts of
Bengaluru, Karnataka, India shall have exclusive jurisdiction over any
dispute arising out of or in connection with these Terms or the
Service.
16. Grievance Officer
In accordance with Rule 3(2) of the IT Rules and Section 8(10) of the
